By: M.S.Yatnatti: Editor and Video Journalist Bengaluru: Justice should prevail in the country Justice for all is the need of the hour .Poor people may not come to questioning government action .while one petitioner come a challenge it before high court and he gets justice and courts limits its order to petitioner .In such cases I feel injustice happens to other persons who are not petitioners stands on same equity. Public Interest in such cases need to be protected .Justice for all is the need of the hour .This matter needs debates in the judicial circles as court cannot do injustice to others who have not approached the court because of their economic problems. Reportedly in India, the Supreme Court took the lead by allowing volunteer social activists- to request the interests of the poor in judicial proceedings by expanding the doctrine of the locus standi in filling the petition and creating epistolary jurisdiction that enabled to treat a letter written on behalf of a disadvantaged person as a petition and examine the merits of the grievances .In India judicial activism was made possible by PIL (Public Interest Litigation). It has in a way democratized the judicial process. Furthermore, the PIL has contributed to the rise of a form of a judicial scrutiny of each and every governmental institution ranging from hospitals, prisons, manufacturing units covering issues of health, environment, safety, security, privacy and welfare etc.Its credit goes to the justice P. N. Bhagwati who has introduced the tradition of hearing on PIL even on a post card. Justice Bhagwati clearly stated, ‘The supreme court has adopted a pro active approach for the last two years. Particularly, having regards to the peculiar socio-economic conditions prevailing in the country’. Thus, judicial activism is developed in each and every aspect of life, including social, economic, political, religious, educational etc. Undoubtedly, it has strengthened the faith of masses in the judiciary of the country. RTI Act serves public interest .The Commission observed: Passing orders in first appeal without hearing or sending hearing notice is illegal and will render the order invalid. The Commission has set aside the order of First Appellate Authority for breach of natural justice .The Right to Information Act, 2005 already provides for imposition of penalty and recommendation of disciplinary action by the Central Information Commission/State Information Commission, as the case may be, against the Public Information Officer who has knowingly given incorrect, incomplete or misleading information under the RTI Act. The CIC/SICs have been imposing such penalties and also recommending disciplinary action against such Public Information Officers and directions issued to all the departments to fix responsibility and take action under the Government Employees Conduct Rules 1957. Giving Knowingly false information and forged information attracts IPC 464 Making a false document and IPC 468. Forgery for purpose of cheating.—Whoever commits forgery, intending that the 1[document or electronic record forged] shall be used for the purpose of cheating, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine. Punishment—Imprisonment for 7 years and fine—Cognizable—Non-bailable—-Triable by Magistrate of the first class—Non-compound­able. Section 166 of IPC : Public servant disobeying law, with intent to cause injury to any person : Whoever, being a public servant, knowingly disobeys any direction of the law as to the way in which he is to conduct himself as such public servant, intending to cause, or knowing it to be likely that he will, by such disobedience, cause injury to any person, shall be punished with simple imprisonment for a term which may extend to one year, or with fine, or with both. Most importantly in cited case law by Karira, the Commission themselves have invoked Section 166 of IPC(but have not initiated any action), which further strengthens this line of argument .The relevant extract from the said Order of the CIC is reproduced below;10. On perusal of this correspondence the Commission is constrained to conclude that Dr. S.K. Sarkar, Joint Secretary (AT&T) has obstructed, and Ms Anuradha Chagti and the DoPT as a public authority have knowingly violated and disobeyed the orders passed by the Commission knowing that the directions given by this Commission under Section 19(8) read with Section 19(7) are binding under the law. By their conduct, they have therefore committed offences punishable under Sections 166, 187 and 188 of the Indian Penal Code.Hence, if proved, the possibility of action under Section 166 of IPC cannot be ruled out.

In the absence of such instruments, including a cheque, the trade and commerce activities, in the present day would, are likely to be adversely affected as it is impracticable for the trading community to carry on with it the bulk of the currency in force. The negotiable instruments are in fact the instruments of credit being convertible on account of legality of being negotiated and are easily passable from one hand to another. To achieve the objectives of the Act, the legislature has, in its wisdom thought it proper to make such provisions in the Act for conferring such privileges to the mercantile instruments contemplated under it and provide special penalties and procedure in case the obligations under the instruments are not discharged.RBI Guidelines on Dishonour of electronic funds transfer for insufficiency of funds in the bank account :Reserve Bank of India vide its circular no. DOC/2011-12/191 DPSS. O.PD.No.497/02.12.004/2011-12 issued on 21 September 2011 have highlighted that section 25 of the Payment and Settlement Systems Act, 2007 accords the same rights and remedies to the payee (beneficiary) against dishonour of electronic funds transfer instructions for insufficiency of funds in the account of the payer (remitter), as are available to the payee under section 138 of the Negotiable Instruments Act, 1881.The sub-section (5) of the section 25 of the Payment and Settlement Systems Act, 2007 provides for punishment of two years and twice the amount of electronic funds transfer instruction, or both for dishonour of such electronic funds transfer on par with the penalties stipulated for dishonour of cheques under the Negotiable Instruments Act, 1881.This information is published to boost the confidence of customers in electronic payments by allaying any apprehensions on the rights and remedies available to payees against dishonour of electronic funds transfer instructions.What is the process for clearing a cheque in India?: Reportedly The clearing process Starts with the deposit of a cheque/other clearing instruments in bank 1. The bank 1 arranges the cheques submitted to it for clearing bank wise and presents it in the clearing house. Upon receipt of the cheques/other instruments, they are passed for payment if the funds are available and the banker is satisfied about the genuineness of the instrument. The said cheque/other clearing instruments is then passed for payment to the beneficiary customer in bank 2.The cheques that are unpaid are returned to the presenting bank through another clearing called the Return Clearing.Central Clearing House: The clearing house is a voluntary association of banks under the management of a bank where the settlement accounts are maintained. Wherever Reserve Bank of India has its office (and a banking department), the clearing house is managed by it. In the absence of an office of the Reserve Bank, the clearing house is managed by the State Bank of India, its associate banks and in a few cases by public sector banks.Settlement Bank: The aggregate amount or value of cheques presented by a bank 1 on bank 2 represents the claim by that bank 1 on bank 2. Similar claims are made by all the banks on every other bank in the clearing. A net settlement is arrived at the clearing house and the debit or credit position of the bank is determined. These are booked in their current accounts maintained by the settling bank.A typical cheque is credit to the beneficiry’s bank account on the 3 working day, here 1st day would be the day of deposit of cheque, 2nd day clearing and 3rd day for crediting the same.

The two years’ time given is coming to an end on 27-10-2019 and BBMP need to regularise at one go all 32563 “Pourakarmikas (Sanitation workers) as they are on BBMP Rolls .Seeking to end years of exploitation by contractors, the State government has decided to absorb outsourced pourakarmikas working for various urban local bodies in the State. The State Cabinet, which met on May 4, has decided to absorb all the contract pourakarmikas in city corporations, city municipal councils, town municipal councils and town panchayats by April 2017, virtually drawing curtains on the contract system of garbage clearance across the State. the Cabinet has also decided to ensure the payment of salaries to the contract pourakarmikas directly from urban local bodies till they are absorbed by the government. “There were complaints that contractors were not giving their full salary and were not paying their Provident Fund (PF) and Employee State Insurance (ESI) dues”.

But it is trauma of IT Industry that Government tenders are more towards vendors and principals and gives little opportunities to partners and they get eliminated in first stage itself and predetermined companies only get tenders and also payment cycle is so designed that only vendors with deeper pocket and working capital coming from their overseas parent companies . it is time to think how Indian SMEs and start up take up Government tenders .Reportedly almost all states and Union territories are showing a friendlier approach to startups extending incubation facilities, facilitating early-stage funding, or even formulating policies for them. However, sourcing from these startups is still only on paper and not in practice. Requirements like prior experience, turnover limits to engage startups, earnest money deposits and other “archaic” sourcing policies impede opportunities for these new generation businesses. An analysis of Startup India’s report that ranks states shows that the 27 states and 3 Union territories assessed fell short when it comes to providing an equal platform for startups vis-à-vis experienced companies in public procurement.“Overall, performance of majority states is below average in this (ease of procurement) pillar as 26 states scored between 0% to 25% of the maximum marks,” the report said. The national average score under this particular criterion was 1.27 out of 14 marks, with performance of majority states defined as ‘below average’.“While at the policy level exemptions have been declared for startups in many of these aspects, the procedures followed by the states are sometimes not in alignment with the Centre,”. “It would be helpful to introduce easier bid eligibility, especially in the case of newer technologies like IOT and smart grids, which would aid infrastructure development,”. “Yes, there is more to be done to move away from age-old tendering procedures, but the open API policy under Digital India is a huge boon for tech entrepreneurs,” noted an expert

Even in many small towns, people use Tally and they pay huge sums for it. I'm glad that there is an open source alternative to it. Apart from being a great movement for people's digital freedom and rights, free software is a great source of earning. Lot of people come to free software due to it's low cost to start with and then tend to like the features most of the time. Then they need customization with few features specifically for their needs. Many corporate pay for free software support and also for specific modifications which they need for running their business. They see the transparency and the low Total Ownership Cost (TOC) as a benefit. GNUKhata is being used by many organizations now.
